1. Who these terms are between
These terms apply to any business that applies for or holds a listing in the We Chose Forever marketplace. They are between your business and QA Culture (Pty) Ltd, registration number 2022/315022/07. Our couple-facing terms apply to couples; these apply to you.
You confirm that you are authorised to enter into these terms on behalf of the business you are listing.
2. What a listing is
A listing puts your business in front of signed-in couples who are actively planning. Most have set a date and a budget, but neither is required of them, so we do not promise that every couple who sees you has done either. Listings are not published to the open internet and are not indexed by search engines — only signed-in couples can see them.
We are a marketplace, not an agent. We do not negotiate on your behalf, we do not take a commission on your bookings, and we are not party to any contract you form with a couple.
3. Getting listed
There is no application to be approved and nobody judges your work. You create your own account and write your own listing. One thing stands between it and the marketplace, and it is the same thing for everybody: before a listing is shown to a single couple, we confirm who is behind it.
Your listing is not visible to couples until that check has passed. Until then you have a full account and a console — you can write the listing, load your photographs and change anything you like — but no couple can find you, and no enquiry can reach you. This is a condition of being listed, not an optional extra.
There are two ways to pass it, and they are equals. If your business is registered, we check the company registration number against the CIPC register, and we re-check it once a year. If you trade in your own name — as most photographers, makeup artists, DJs and celebrants do — we confirm your identity from your ID number instead, once. Neither path gives you a better listing, a better position or a lower price than the other.
We keep a registered company's registration number, because the annual re-check needs it and it is public information about your business. We do not keep an ID number: it is used for the one check and then deleted, it is never stored against your listing, and it is never shown to a couple. Our privacy policy says the same thing and binds us to it.
The check confirms who you are and nothing else. It is not an assessment of your work, your pricing, your insurance or your conduct, we do not present it to couples as one, and clause 12 says what it does not promise you in return.
Until you take a paid listing your account is on the free tier. You ARE in the marketplace on the free tier once you are through the check above: couples see your name, the town you work in, your price, your description, your answers to the common questions in your category and up to five photographs, and they can open and favourite you. What a paid listing adds is the other half of the gallery, your availability calendar, the funnel and lead tables on your console, and opening every enquiry without spending credits. There is no trial and no countdown.
Being listed is not a warranty from us to couples about your work, and we tell couples so. Separately from the check above, we reserve the right to remove a listing that breaks these terms, our acceptable use policy, or clause 4 on accuracy — that one happens after the fact and on cause.
3A. How couples are matched to your listing
Couples see vendor suggestions generated by our software from what they have told us — their date, budget, location and category. Which listings appear, and in what order, is determined by our systems.
Below the Featured places, the order is deliberately random and is drawn again on every page a couple loads. Every other listing in a category has the same chance of any position, whether it is paid for or free — nothing is ordered by how long you have been here, by your name, or by what you pay. This is why your own position moves when you reload: it is the rotation working, not a fault. Where a couple is being shown vendors by locality, the rotation happens inside each area rather than across them, so being nearest to a couple is never shuffled away.
We may change how matching works at any time, without notice. Your visibility may go up or down as a result, and that does not entitle you to a refund or a reduction in fees.
Your listing fee buys you a place in the marketplace. It does not buy a number of enquiries, bookings or any level of revenue. We do not publish figures for the leads or bookings a listing produces, and we will not quote you one. If a number is ever mentioned to you — in an email, on a call, anywhere — it is illustrative and is not a term of this agreement. Clause 12 says the same thing about the metrics on your console.
We do not screen enquiries for quality, and we do not verify that a couple is serious or has budget. An enquiry is an enquiry.
4. Accuracy — the obligation that matters most
Everything in your listing must be true and current: your business name, the area you serve, your price and pricing basis, your description, and your photographs. Couples make favouriting decisions on the strength of those figures, and the budget filter that decides who sees your listing runs off your price.
- Publish a price you will honour. If a price is a starting figure or a ceiling, say so using the pricing basis — that is what it is for.
- Update your listing when your prices or service area change.
- Do not list a business you do not own or are not authorised to represent.
- Do not describe qualifications, awards, accreditations or affiliations you do not hold.
- Do not misrepresent your availability.
Misleading a consumer about price, availability or the nature of a service is an offence under the Consumer Protection Act 68 of 2008, quite apart from our terms. We remove listings that do it.
5. Your photographs
- You may upload up to 10 photographs.
- You must own the copyright in each one, or hold a licence that allows you to publish it commercially. Photographs of your own work usually belong to the photographer who took them, not to you — get their written permission.
- Where a photograph shows identifiable people, you must have their permission to publish it.
- You grant us a non-exclusive, royalty-free licence to display and resize those photographs for the purpose of showing your listing. It ends when you delete them or your listing.
6. Couple information you receive — your obligations
When a couple favourites or books you, and has consented to sharing, you receive their names, wedding date and location. You never receive their budget — that figure is private to the couple and our database does not permit a vendor account to read it. Do not ask a couple for it as a condition of quoting.
The moment you receive a couple's details you become a responsible party for them under POPIA, with your own obligations.
You agree that you will:
- Use those details only to respond to that couple about that wedding.
- Not add a couple to a mailing list, newsletter or marketing campaign without their separate consent, as POPIA s69 requires.
- Not sell, share, or otherwise pass those details to anyone else.
- Quote the couple your real price. You do not know what they can spend, and you may not make sharing it a condition of quoting.
- Keep the details securely, and delete them when you no longer have a reason to hold them.
- Comply with POPIA generally, including registering your own Information Officer.
We may suspend or remove a listing that breaches this section, and a serious breach is something we will report.
Couples may also decline to share their identity. Where a couple has done so, you will see that a couple has favourited you but not who they are. That is their right and you may not condition your response on it.
7. Scraping and automated access
You may not scrape, copy, index or bulk-extract listings, couples, prices or any other data from the service, whether by script or by hand, and you may not use another vendor's listing data to build your own. Accounts doing this are closed without notice.
8. The free tier and listing fees
A new vendor account is free and stays free. Once the identity check in clause 3 has passed, your listing is in the marketplace — your name, your town, your price, your description and your answers to the standard questions in your category — and couples can find and favourite you. When a couple writes to you, opening their message costs credits unless you hold a paid listing; if you do not open it within 48 hours the couple takes their credits back and we record the lead as missed. An account is kept for as long as it is used. If nobody signs in to a free account for 90 days, the account and everything in it — the listing, its photographs and the enquiries on it — is permanently deleted and cannot be recovered. We write to you first: a notice 14 days before the date and a final one 7 days before it, and nothing is ever deleted without both of those letters having gone. Signing in from time to time is all it takes to keep a listing.
Listing prices are set by category and are on our pricing page and in your console. The price you are shown before you buy is the price charged, and a term you have already paid for is not affected if we change the rate card afterwards. Our refund and cancellation policy applies.
9. Messaging couples, and reporting
A couple writes to you first — you cannot open a conversation with one. That channel is for answering them about their wedding. Abuse, threats, sexual propositions, harassment and unsolicited advertising sent through it breach these terms, and so does sending explicit material of any kind through it or publishing it on your listing.
You can report a couple from the conversation itself, and they can report you the same way. A copy of the conversation as it stands is attached to the report; the person reporting is told that before they send it. A report reaches us and nothing else — nobody is suspended or notified automatically. A person reads it and decides, and we do not tell the person reported who reported them.
10. Your calendar and availability
The availability shown against your listing is the calendar you keep yourself, and nothing else. We do not generate, infer or fill in dates on your behalf. A day you have not marked is shown to couples as one you have not answered about — never as free — so keeping it current is yours to do, and a couple should still confirm a date with you directly before either of you relies on it.
11. Suspension and removal
We reserve the right to suspend or remove a listing that breaches these terms, that we reasonably believe misleads couples, or that attracts substantiated complaints. Except where the breach is serious, we will tell you why and give you an opportunity to fix it. Where we remove a paid listing other than for your breach, we refund the unused portion.
Where we suspend or remove a listing because you breached these terms or our acceptable use policy, what is left of the listing fee is not refunded. Our refunds page says the same thing. For abuse, threats, explicit content or anything that endangers a person, we act immediately and tell you afterwards.
You may close your account at any time from your console. Doing so removes your listing and deletes your data.
12. Our liability
We do not guarantee any number of views, leads or bookings. Metrics on your console are our best measurement, not a warranty. Subject to liability that cannot lawfully be limited, our total liability to you is limited to the listing fees you have paid us in the twelve months before the claim.
13. Law, changes and contact
South African law governs these terms. We version them, and we will notify you of a material change and ask you to accept it rather than assume it.
